Ex-Parte Communication Disclosures Regarding California WaterFix

The Department of Water Resources (DWR) on July 27 filed a certification of consistency with the Delta Plan for its WaterFix project. Ten days before that filing, when DWR first posted a draft certification on its WaterFix website, the Council (including its staff and consultants) placed itself under ex parte communication restrictions in anticipation of its quasi-judicial role with respect to the WaterFix project (see Government Code section 11430.10).

 

These restrictions will remain in place for the duration of the Council’s statutory review.

 

The purpose of the disclosures, filed by date below, is to alert the public to any ex parte communication related to the Council’s anticipated appellate review of California WaterFix.

 

 

Coequal goals

The Delta Stewardship Council was created in legislation to achieve the state mandated coequal goals for the Delta. "'Coequal goals' means the two goals of providing a more reliable water supply for California and protecting, restoring, and enhancing the Delta ecosystem. The coequal goals shall be achieved in a manner that protects and enhances the unique cultural, recreational, natural resource, and agricultural values of the Delta as an evolving place." (CA Water Code §85054)
