The Delta Stewardship Council was created in legislation to achieve the state mandated coequal goals for the Delta. "'Coequal goals' means the two goals of providing a more reliable water supply for California and protecting, restoring, and enhancing the Delta ecosystem. The coequal goals shall be achieved in a manner that protects and enhances the unique cultural, recreational, natural resource, and agricultural values of the Delta as an evolving place." (CA Water Code §85054)
The comment period on the Draft Program EIR for the staff draft Delta Plan closed February 2, 2012. Comment letters and other comment submissions we received are available for review at this web address: http://deltacouncil.ca.gov/public-comments. The submissions, and written responses, will be published in a Final EIR anticipated sometime in 2012.
The Draft Environmental Impact Report (DEIR) has been prepared by the Delta Stewardship Council staff. The Council is the Project proponent and state lead agency under the California Environmental Quality Act (CEQA) for the Delta Plan. CEQA generally requires lead agencies to consider the environmental consequences of a project over which they have discretionary authority before approving, carrying out, or funding the project. Under CEQA, a project is an activity which may cause either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. CEQA requires a lead agency to prepare an EIR if there is a fair argument that the project may have a significant environmental effect.
The action considered by the Council is the adoption of the Delta Plan. The suite of twelve binding regulatory policies and sixty-one nonbinding recommendations contained in the fifth staff draft Delta Plan released in August 2011 is what the DEIR calls the "Proposed Project" or "Project."
CEQA requires that the lead agency use its independent judgment to formulate and evaluate in an EIR a reasonable range of alternatives to the project that could "feasibly attain most of the basic objectives of the project and avoid or substantially lessen any of the potential adverse environmental impacts of the project." Consequently, this DEIR also describes five alternatives of the Proposed Project, which are analyzed at the same level of detail as the Proposed Project. In addition to the "No Project Alternative" (which assesses the environment as if no Delta Plan is adopted), the DEIR includes four alternatives that are based upon, and informed by (but not taken verbatim from), comments and alternative proposals received from various stakeholder groups, communities, and other interested persons.
Because the Council does not propose or contemplate constructing, owning, or operating any facilities or directly undertaking any specific activities to implement the Delta Plan recommendations or regulatory policies, there would be no direct physical change in the environment through adoption of the Delta Plan. However, adoption of the Delta Plan by the Council could influence the nature and shape of decisions and actions by other agencies (particularly where those actions are "covered actions" under the Delta Reform Act). Those decisions and actions, as potentially influenced by the Delta Plan, could cause physical changes in the environment. Those potential physical changes are what the DEIR evaluates.
The Delta Plan EIR is programmatic in nature due to the broad nature of the Delta Plan. Future environmental documents would be completed by other agencies when they implement projects that are subject to consistency reviews by the Council, or which are encouraged or otherwise influenced by the Delta Plan. This programmatic EIR is not intended to provide project-level clearance for any specific project.
